Welcome to Auction Hut. By using the Auction Hut services, you agree to the following terms with Auction Hut. If you have any questions, please contact Customer Service at firstname.lastname@example.org
This Agreement is effective from 25 April 2019 for all users and upon acceptance for new users.

What are the General posting rules?
General Auction Hut Posting Policies as a condition of use of Auction Hut you agree that you are at least 18 years of age.
General reasons for ads being deleted are:
Items being offered for sale are not allowed to be sold on Auction Hut: Guns, Drugs.
Including information in your ad which Auction Hut believes is designed to manipulate search
The ad is a duplicate of another ad previously postedPosted under wrong category (You must choose the single most relevant category for your ad)Ads posted in a language other than English. We only accept ads in English. It’s acceptable to include a translation of your ad in another language in addition to EnglishAds posted from overseas or from behind a VPN: No overseas ads, or ads posted without an Australian IP address are accepted, Auction Hut is for Australian based individuals and businesses only.Can I add external links ?.
YES. Before using the Auction Hut services, you must read and accept all of the terms in, and linked to, this User Agreement (“Agreement”) and the Auction Hut User Privacy Notice. We strongly recommend that, as you read this User Agreement, you also access and read the hyperlinked information. By accepting this User Agreement, you agree that this User Agreement and User Privacy Notice will apply whenever you use the Auction Hut services, or when you use the tools we make available to interact with the Auction Hut services. If you use an Auction Hut site other than Auction Hut.com.au, you acknowledge that you will need to accept and be bound by the terms of that site. Some Auction Hut services may have additional or other terms that we provide to you when you use those services.
3. Using Auction Hut
While using the Auction Hut services, you will not:
post content or items in inappropriate categories or areas on our sites and services;
infringe any laws, third party rights or our policies, such as the prohibited and restricted items policies;
use the Auction Hut services if you are not able to form legally binding contracts, are under the age of 18 or are suspended from using the Auction Hut services;
fail to deliver payment for items purchased by you, unless the seller has materially changed the item’s description after you bid, a clear typographical error is made or you cannot authenticate the seller’s identity;
fail to deliver items purchased from you, unless the buyer fails to meet the posted terms or you cannot authenticate the buyer’s identity;
manipulate the price of any item or interfere with other users’ listings;
circumvent or manipulate our fee structure, the billing process, or fees owed to Auction Hut;
post false, inaccurate, misleading, defamatory or offensive content (including personal information);
take any action that may undermine the Feedback or ratings systems (such as displaying, importing or exporting Feedback information or using it for purposes unrelated to Auction Hut);
transfer your Auction Hut account (including Feedback) and user ID to another party without our consent;
distribute or post spam, unsolicited or bulk electronic communications, chain letters or pyramid schemes;
distribute viruses or any other technologies that may harm Auction Hut or the interests or property of Auction Hut users;
export or re-export any Auction Hut tools except in compliance with the export control laws of any relevant jurisdictions;
copy, modify or distribute rights or content from the Auction Hut services or Auction Hut’s copyrights and trademarks; or
harvest or otherwise collect information about users, including email addresses, without their consent.
4. Abusing Auction Hut
Auction Hut and its community of users (“the Community”) work together to keep our sites and services working properly and the Community safe. Please report problems, offensive content, and policy violations to us.
Auction Hut’s Verified Rights Owner (VeRO) Program works to ensure that listed items do not infringe upon the copyright, trademark or other intellectual property rights of third parties. If you believe that your intellectual property rights have been violated, please notify our VeRO team and we will investigate.
Without limiting other remedies, we may limit, suspend or terminate our service and user accounts, prohibit access to the Auction Hut services, delay or remove hosted content, remove, delete, modify or not display listings, apply fees and/or recover our expenses for policy monitoring and enforcement, and/or take technical and legal steps to keep users off the sites if we think that they are creating problems or possible legal liabilities, infringing the intellectual property rights of third parties or acting inconsistently with the letter or spirit of our policies (for example, and without limitation, policies related to shill bidding, conducting off-Auction Hut transactions, Feedback manipulation, circumventing temporary or permanent suspensions or users who we believe are harassing our employees or other users). Additionally, we may, in appropriate circumstances and at our reasonable discretion, suspend or terminate accounts of users who may be repeat infringers of intellectual property rights of third parties. We also reserve the right to cancel unconfirmed accounts or accounts that have been inactive for a long time, or to modify or discontinue Auction Hut services.
If you are a seller and you offer or reference your contact information or ask a buyer for their contact information in the context of buying or selling outside of Auction Hut, you may be liable to pay a final value fee applicable to that item.
5. Fees and Services
Joining Auction Hut and bidding on listed items is free. When you list an item or use a service that has a fee, you have an opportunity to review and accept the fees that you will be charged based on our Fees schedule, which we may change from time to time. Changes to that schedule are effective after we provide you with at least fourteen days’ notice by posting the changes on the Auction Hut site. We may choose to temporarily change the fees for our services for promotional events (for example, free listing days) or new services, and such changes are effective when we post the temporary promotional event or new service on the sites.
If you are a seller, you are liable for transaction fees arising out of all sales made using some or all Auction Hut services, even if sales terms are finalised or payment is made outside of Auction Hut. In particular, if you offer or reference your contact information or ask a buyer for their contact information in the context of buying or selling outside of Auction Hut, you will be liable to pay a final value fee applicable to that item.
Unless otherwise stated, all fees are quoted in Australian Dollars. You are responsible for paying all fees and applicable taxes associated with our sites and services in a timely manner with a valid payment method. If your payment method fails or your account is past due, we may collect fees owed using other collection mechanisms. (This includes charging other payment methods on file with us, retaining collection agencies and legal counsel and, for accounts over 180 days past due, deducting the amount owed from your PayPal account balance or using any credits on your account.)
When you upload content to the Auction Hut website or otherwise give us content,you grant us a non-exclusive, worldwide, perpetual, irrevocable, royalty-free, sublicensable (through multiple tiers) right to exercise any and all intellectual property rights (including copyright and trademark rights you have in the content, in any media known now or in the future and for any other purpose.
If you are the author of that content, you also irrevocably and unconditionally consent, to the maximum extent permitted by law (either present or future), to Auction Hut and its licensees, contractors, assignees and successors, and their licensees and any other person authorised by any of them (“Auction Hut Authorised Persons”):
(a) disclosing, reproducing, copying, adapting, publishing, performing, exhibiting, communicating, renting, transmitting or otherwise using the content (and any adaptation or part of the content) anywhere in the world:
(i) in whatever form and in whatever circumstances Auction Hut and the Auction Hut Authorised Persons think fit, including adding to or otherwise altering the content (or any adaptation or part of the content); and
(ii) without making any identification of you as the author in relation to the content (or any adaptation or part of the content); and
(b) doing anything or omitting to do anything in relation to the content (or any adaptation or part of the content) anywhere in the world that would otherwise infringe the moral rights, or any similar non-assignable, personal rights, that you might have.
For the convenience of sellers, we may offer catalogues of stock images, descriptions and product specifications that are provided by third parties (including Auction Hut users). You may use catalogue content solely in connection with your Auction Hut listings during the time your listings are on Auction Hut’s sites.
While we try to offer reliable data, we cannot promise that the catalogues will always be accurate and up-to-date, and you agree not to hold our catalogue content providers or us responsible for inaccuracies in catalogues. If you choose to include catalogue content in your listings, you continue to be fully responsible for your listings and for ensuring that your listings are accurate, do not include misleading information and comply with this User Agreement and all Auction Hut policies. The catalogues may include copyrighted, trademarked or other proprietary materials. You agree not to remove any copyright, proprietary or identification markings included with the catalogues or create any derivative works based on catalogue content (other than by including them in your listings).
7. Trading on Auction Hut and Limitation of Liability
While we strive to maintain a safe trading environment you accept that there are unfortunately sometimes risks when trading online and using our sites, including dealing with underage or fraudulent persons. You will not hold Auction Hut responsible for other users’ content, actions or inactions, items they list or their destruction of allegedly fake items. You acknowledge that we are not an auctioneer. Instead, our sites are venues to allow anyone to offer, sell, and buy just about anything, at any time, from anywhere, in a variety of pricing formats and locations, such as Stores, fixed price formats and auction-style formats. We are not involved in the actual transaction between buyers and sellers. We have no control over and do not guarantee the quality, safety or legality of items advertised, the truth or accuracy of users’ content or listings, the ability of sellers to sell items, the ability of buyers to pay for items or that a buyer or seller will actually complete a transaction or return an item. You should consider and use all of our suggested safe trading guidelines when trading online, including our safe trading tips for buyers and tips for sellers on avoiding transaction problems.
When you enter into a transaction you create a legally binding contract with another user, unless the item is listed in a category under the Non-Binding Bid Policy. You must ensure that you comply with your obligations to that other member and are aware of any laws relevant to you as a buyer or seller. If another member breaches any obligation to you, you – not Auction Hut – are responsible for enforcing any rights that you may have.
You alone, and not Auction Hut, are responsible for ensuring that your listing, bidding and selling and any other activities conducted on our site are lawful. You must ensure that you comply with all applicable laws in Australia and other countries. You must also ensure that you strictly comply with this Agreement and the policies which form part of the Agreement.
We do not take ownership of the items at any time and do not transfer legal ownership of items from the seller to the buyer. Further, we cannot guarantee continuous or secure access to the Auction Hut services, and their operation may be interfered with by numerous factors outside of our control. Accordingly, to the extent legally permitted, we exclude all implied warranties, terms and conditions. We are not liable for any loss of money, goodwill or reputation, or any special, indirect or consequential damages arising, directly or indirectly, out of your use of or your inability to use the Auction Hut services.
To the extent that Auction Hut is able to limit the remedies available under this Agreement, Auction Hut expressly limits its liability for breach of a non-excludable statutory guarantee to the following remedies:
the supply of the services again; or
the payment of the cost of having the services supplied again.
If you have a dispute with one or more users, you release us (and our officers, directors, agents, subsidiaries, joint venturers and employees) from claims, demands and damages (actual and consequential) of every kind and nature, known and unknown, arising out of or in any way connected with such disputes.
Without limiting other remedies available to Auction Hut at law, in equity or under this Agreement, we may, without notice to you and in our sole discretion (which shall be exercised reasonably, having regard to the circumstances), delay listing your item, delete your listing, issue you a warning, restrict your activities through our site (including but not limited to buying, selling and posting activities), temporarily suspend, indefinitely suspend or terminate your membership and refuse to provide our services to you, or require you to pay additional fees if:
you have, or we believe that you have, breached this Agreement, which includes any of our Policies in any way (including those Policies referred to in Clause 22 below);
we are unable to verify or authenticate any information you provide to us;
we believe that your actions may cause loss or damage to or otherwise unlawfully harm you, our users, third parties or us, our related bodies corporate or affiliates, our directors, employees or agents; or
if we reasonably believe that any of your information (which includes an item listed on the site) is inappropriate or of an offensive nature.
For security, confidentiality and privacy reasons, we are not obligated to provide you or other members the details of any investigation that we conduct or any action which we take, in relation to your membership or your account other than those that are already provided to you by us.
11. Restricting Funds
To protect against the risk of liability, Auction Hut may request, and you agree to authorise the request, that PayPal restrict access to funds in a seller’s PayPal account based on certain factors, including, but not limited to, selling history, seller performance, returns, riskiness of the listing category or the filing of a case. This may result in PayPal determining to restrict funds in your PayPal account in order to manage PayPal’s risk exposure pursuant to PayPal policies.
12. Access and Interference
The sites contain robot exclusion headers. Much of the information on the sites is updated on a real-time basis and is proprietary or is licensed to Auction Hut by our users or third parties. You agree that you will not use any robot, spider, scraper or other automated means to access the Auction Hut services for any purpose without our express written permission.
Additionally, you agree that you will not:
take any action that imposes or may impose (in our sole discretion, exercised reasonably) an unreasonable or disproportionately large load on our infrastructure;
copy, reproduce, modify, create derivative works from, distribute or publicly display any content (except for your information) from the sites without the prior express written permission of Auction Hut and the appropriate third party, as applicable;
interfere or attempt to interfere with the proper working of the sites, services or tools, or any activities conducted on or with the sites, services or tools; or
bypass our robot exclusion headers or other measures we may use to prevent or restrict access to the sites.
13. Listing Conditions
By listing an item on Auction Hut’s sites, you agree to pay Auction Hut’s fees for the listing, assume full responsibility for the content of the listing and item offered, and accept the following listing conditions:
When you list an item on Auction Hut’s sites, your listing will be posted on Auction Hut’s sites and can be viewed in My Auction Hut.
Your listing may not be immediately searchable by keyword or category for several hours (or up to 24 hours in some circumstances), so Auction Hut can’t guarantee exact listing durations.
We may revise data in the Auction Hut product catalogue to supplement, remove, or correct information; if your listing uses catalogue data that has been revised, those revisions may modify your listing accordingly.
Where your listing appears in search and browse results may be based on certain factors including listing format, title, bidding activity, end time, keywords, price and postage cost, Feedback and detailed seller ratings. Learn more about where your listings appear in search and browse results.
Your listing will, at all times, comply with Auction Hut rules and policies, including listing rules.
14. Selling Internationally
You may be able to sell your items internationally by listing items for sale directly on one or more of Auction Hut’s international sites or where you choose to list items with an international postage option. You agree that we may display your listing on an Auction Hut site other than the Auction Hut site where you listed your item for sale, including those situations where you choose to list items with an international postage option (such as worldwide postage). However, you may restrict international buyers from purchasing your items if you explicitly exclude international postage locations from your listings or by creating and applying an exclusion list to your listings.
You agree that 1) a buyer on a Auction Hut site other than your Auction Hut site of registration makes a successful claim against you under an Auction Hut buyer protection program on the Auction Hut site where your item is sold; and 2) Auction Hut makes a payment to the buyer in respect of this claim, then Auction Hut may recoup this money from you. If you have a PayPal account, the funds will be deducted from your PayPal account, Auction Hut may charge the automatic payment method (if any) that you have on file with your Auction Hut site of registration (such as a credit card or, if PayPal is your automatic payment method, any payment methods or funding sources linked to your PayPal account). If your item is sold to a buyer on an Auction Hut site other than your Auction Hut site of registration, you agree to be subject to that other site’s User Agreement and policies with respect to that particular purchase. You are responsible for complying with all laws and regulations applicable to the sale and delivery of items to international buyers and are responsible for paying all fees and applicable taxes or charges associated with Auction Hut sites and services such as GST or VAT.
15. Closing Your Account.
You may close your Auction Hut account at any time, subject to:
not having any outstanding items listed on the website; and
resolving any outstanding matters (such as a suspension or restriction on your account); and
paying any outstanding fees owing on the account.
We do not provide your personal information to third parties for their marketing purposes without your explicit consent. We use your information only as described in the Auction Hut User Privacy Notice. We view protection of users’ privacy as a very important community principle. We store and process your information on computers located in the United States that are protected by physical as well as technological security devices. You can access and modify the information you provide us and choose not to receive certain communications by signing in to your account. We use third parties to verify and certify our privacy principles. For a complete description of how we use and protect your personal information, see the Auction Hut User Privacy Notice. If you object to your information being transferred or used in this way please do not use our services.
Privacy of Others; Marketing
If Auction Hut provides you with information about another user you agree you will use the information only for the purposes it is provided to you. You may not disclose, sell, rent or distribute a user’s information to a third party for purposes unrelated to the Services. Additionally, you may not use information for marketing purposes, via electronic or other means, unless you obtain the consent of the specific user to do so.
You will indemnify us (and our officers, directors, agents, subsidiaries, joint venturers and employees) against any claim or demand, including legal fees and costs, made against us by any third party due to or arising out of your breach of this Agreement, or your infringement of any law or the rights of a third party in the course of using the Auction Hut services.
18. No Agency
Auction Hut is not your agent for any purpose in relation to this Agreement or your use of the Auction Hut services.
Legal notices must be served on Auction Hut’s registered agent (in the case of Auction Hut) or to the email address you provide to Auction Hut during the registration process (in your case). Notice will be deemed given 24 hours after email is sent, unless the sending party is notified that the email address is invalid or that the email has not been delivered. Alternatively, we may give you legal notice by mail to the address provided by you during the registration process. In such case, notice will be deemed given three days after the date of mailing.
20. Legal Disputes
If a dispute arises between you and Auction Hut, our goal is to provide you with a neutral and cost effective means of resolving the dispute quickly. We strongly encourage you to first contact Customer Service to seek a resolution. If your dispute is not resolved by contacting Customer Service, all legal notices and formal disputes should be sent to Auction Hut’s registered agent in accordance with Clause 20 above. We will consider reasonable requests to resolve the dispute through alternative dispute resolution procedures, such as mediation or arbitration, as alternatives to litigation.
Law and forum for legal disputes
This Agreement will be governed in all respects by the laws of New South Wales. We encourage you to try and resolve disputes using certified mediation (such as online dispute resolution processes). If a dispute cannot be resolved then you and Auction Hut irrevocably submit to the non-exclusive jurisdiction of the courts of Queensland, Australia.
Auction Hut is located at Broadbeach, Australia.
If any provision of this Agreement is held to be invalid or unenforceable, such provision will be severed and the remaining provisions will remain in effect. In our sole discretion, we may assign our rights and obligations under this Agreement to another entity. Headings are for reference purposes only and do not form part of this Agreement. Our failure to act on a breach by you or others doesn’t waive our right to act on subsequent or similar breaches.
We may amend this Agreement at any time by posting the amended terms on Auction Hut.com.au. We will also notify you of any material amendments through Auction Hut Messages (in My Auction Hut) or directly to the email address linked to your account. Except as stated elsewhere, all amended terms will automatically be effective 30 days after they are initially posted. If you do not accept the changes you should close your account in accordance with Clause 15 of this Agreement.
This Agreement contains the entire understanding and agreement between you and Auction Hut. The following Sections survive any termination of this Agreement: Fees and Services (with respect to fees owed for our services), Release, Content, Liability, Indemnity and Legal Disputes.
Prohibited and restricted items
Before listing an item, make sure we allow it on Auction Hut. Get an overview of items that are prohibited or subject to restrictions, or click a link below to learn about items members frequently ask us about.
Drugs and drug paraphernalia.
RULES FOR BUYERS:
We want to maintain a safe, fair, and enjoyable marketplace for both buyers and sellers. If you’re a buyer, we ask that you review and understand our policies, including the Auction Hut User Agreement, before you bid on or buy an item.
Our policies are intended to:
· Follow local laws and regulations
· Minimise risks to buyers and sellers
· Make sure that no one has an unfair advantage
· Create an enjoyable buying experience
· Protect intellectual property rights
Auction Hut’s policies help to create a safer, fair and enjoyable trading experience for all members. As a seller, you are responsible for reviewing and understanding Auction Hut’s selling policies, as well as all applicable laws and regulations outlined in the User Agreement.
We recommend that you learn about Auction Hut’s selling policies before you list an item. This will help you to avoid accidentally breaking rules. Also, Auction Hut’s selling policies are updated often to address emerging issues, so it is important to check them regularly for changes.
Make sure you follow these guidelines. If you don’t, you may be subject to a range of actions, including limits of your buying and selling privileges and suspension of your account.
Rules about bidding and paying
You can’t use Auction Hut if your account contains false contact information.
Buyers and sellers sometimes need to be able to get in touch with each other, and we need to be able to contact our members.
You must pay for any item you commit to buying.
Some Auction Hut sellers use an auction-style format, allowing you to bid on an item. Bidding is fun, but keep in mind that each bid you make is a binding contract to buy the item if you win. The same is true for Buy It Now purchases. Not paying for an item after you agree to buy it has negative consequences, explained in our unpaid item policy.
You can only bid if you really intend to buy the item, even if you’re making a non-binding bid.
You can only make non-binding bids on certain items, such as real estate and businesses. This type of bid still means that you intend to buy the item. The bottom line is, don’t place a bid unless you mean to buy the item.
You can’t bid on your own item.
We call this shill bidding and it not only violates our policies, it’s against the law in many places.
Be careful about bidding on several items if you only want one.
If you’re the winning bidder of more than one auction-style listing, you need to purchase all the items you’ve won, even if they’re the same or similar.
You can only retract a bid under specific circumstances.
For example, if you meant to bid $10.00 but accidentally bid $1,000.00, you can retract the bid. Even then, you need to bid the amount you originally intended immediately. Never use bid retraction to manipulate the bidding process. Bid manipulation is unfair, and it has serious consequences. Learn more about retracting or cancelling your bid.
Make sure that you read the listing description before you bid.
Many of the problems buyers and sellers encounter are the result of simple misunderstandings about what is for sale and the terms of the sale. For example, some sellers only want to sell to bidders who live in a certain country, or who will pay using PayPal. Only bid on or buy an item if you can meet the requirements described in the listing. If you bid on an item and you don’t meet the seller’s requirements, we consider that unwelcome and malicious buying.
If you know the seller, you can’t bid on the item with the intent to increase its price or desirability artificially.
This rule applies to family, friends, roommates, employees and online connections.
Buying items from someone just to increase their Feedback score or improve their search standing is called shill bidding, and it’s against our policies.
You can offer to buy items outside of Auction Hut.
Our policies don’t cover items bought outside of our site. If you buy items outside of Auction Hut, we don’t protect you against fraud. Sellers must follow the same rule, so if a seller offers to sell you something outside of Auction Hut, don’t accept the offer. For more information, see our rules for everyone.
If you buy an item from a seller in another country, you can’t ask the seller to mark the item as a gift in the customs declaration.
This is illegal, and against our policies. Learn more about our rules against encouraging illegal activity.
Rules about Feedback
You can’t abuse the Feedback system.
This means you can’t threaten to leave a seller negative Feedback if that seller won’t do something that wasn’t promised in the original listing. This is called Feedback extortion and is against our policy.
Also, you can’t leave Feedback if you’re only doing it to help increase a seller’s Feedback score. This is a type of Feedback manipulation and is also not allowed.
Make sure that you understand and follow all of our Feedback policies.
If you’re having a problem with a seller
Be honest and have good intentions when you try to resolve a transaction problem. Learn more about what to do if you don’t receive an item or it doesn’t match the listing description.
Attempts to manipulate the Auction Hut Money Back Guarantee process are prohibited and can have serious consequences.
You can’t try to contact other potential buyers to “warn” them about a seller. This is called transaction interference. If you have a concern about a seller’s behaviour, report it to us and we’ll investigate.

If you’re also a seller, please be sure to read our rules for sellers, and make sure that your listings follow our guidelines.
Scope and Consent
This Privacy Notice describes our collection, use, disclosure, retention, and protection of your personal information. It applies to any Auction Hut site where this Privacy Notice appears in the footer, and to any Auction Hut application, service, or tool (collectively “Services”) where this Privacy Notice is referenced, regardless of how you access or use them, including through mobile devices. By using our Services and/or registering for an account with us, you are accepting the terms of this Privacy Notice and our User Agreement, and you are consenting to our collection, use, disclosure, retention and protection of your personal information as described in this Privacy Notice.
Global Privacy Standards
Auction Hut has established global privacy standards for all Auction Hut companies known as Binding Rules (BCRs). They are our commitment to protect your personal information and honour our privacy obligations regardless of where your personal information is collected, processed or retained within our Auction Hut .
We collect, process and retain personal information from you and any devices (including mobile devices) you may use when you: use our Services, register for an account with us, provide us information on a web form, update or add information to your account, participate in community discussions, chats or dispute resolution, or when you otherwise correspond with us regarding our Services.
Use and Retention
We use the personal information we collect to: provide and improve our Services, provide you with a personalised experience on our sites (especially, by offering you services and items that you may like), contact you about your account and our Services, provide you customer service, provide you with personalised advertising and marketing, and detect, prevent, mitigate and investigate fraudulent or illegal activities.
We retain your personal information as long as it is necessary and relevant for our operations. In addition, we may retain personal information from closed accounts to comply with national laws, prevent fraud, collect any fees owed, resolve disputes, troubleshoot problems, assist with any investigation, enforce our User Agreement and take other actions permitted or required by applicable national laws.
You have a choice about how we use your personal information to communicate with you, send you marketing information, and provide you with personalised advertising, and whether you want to stay signed into your account.

The company you are contracting with is your data controller, and is responsible for the collection, use, disclosure, retention and protection of your personal information in accordance with our global privacy standards as well as any applicable national laws. Your data controller may transfer data to other members of the Auction Hut as described in this Privacy Notice. We may process and retain your personal information on our servers in the U.S. where our data centres are located.
“Personal information” is information that can be associated with a specific person and could be used to identify that specific person whether from that data, or from that data and other information that Auction Huthas or is likely to have access to. We do not consider personal information to include information that has been made anonymous or aggregated so that it can no longer be used to identify a specific person, whether in combination with other information or otherwise.
Changes to this Notice
We may amend this Privacy Notice at any time by posting the amended terms on this site. All amended terms automatically take effect 30 days after they are posted. We will announce any material changes to this Privacy Notice through Auction Hut Messages and/or via email.
Global Privacy Standards
Auction Hut has established global privacy standards for all Auction Hut companies known as our Binding Rules (BCRs). They are our commitment to protect your personal information and honour our privacy obligations regardless of where your personal information is collected, processed or retained within our Auction Hut . Our BCRs have been approved by a number of European Union privacy regulators. That means we are treating your personal information everywhere within our Auction Hut according to European Union privacy standards. Personal information from other sources
We may supplement the information we collect with information from third parties and add it to your account information. For example, we may collect and use demographic information that is publically available, additional contact information, credit check information and information from credit bureaus, as allowed by applicable national laws.
We may allow you to share information with social media sites, or use social media sites to create your account or to connect your account with the respective social media site. Those social media sites may automatically give us access to certain personal information retained by them about you (e.g. content viewed by you, content liked by you and information about the advertisements you have been shown or may have clicked on, etc.). If you provide us with access to any site with video content, then you agree that we may share your video viewing with, or obtain information about your video viewing from, third-party social media sites for at least two years or until you withdraw consent. You control the personal information you allow us to have access to through the privacy settings on the applicable social media site and the permissions you give us when you grant us access to your personal information retained by the respective social media site about you. By associating an account managed by a social media site with your account and authorising us to have access to this information, you agree that we may collect, use and retain the information provided by these social media sites in accordance with this Privacy Notice.
If you give us personal information about someone else, you must do so only with their explicit and prior consent. You have to inform them how we collect, use, disclose and retain their personal information according to our Privacy Notice.

We retain your personal information as long as it is necessary and relevant for our operations. You can control the methods by which we may contact you about your account and your buying and selling activities in the Communication Preferences section within My Auction Hut. There, you can also control your member-to-member communications preferences settings and choose which newsletters and promotions you want to receive.
If you do not wish to receive marketing communications from us, you can unsubscribe from the link in the email you received, change your Communication Preferences within My Auction Hut, or indicate your communication preferences within the direct communication from us. Keep in mind, we do not sell or rent your personal information to third parties for their marketing purposes without your explicit consent.
If you do not wish to participate in our advertising personalisation programs, you can opt out by following the directions provided within the applicable advertisement, or directly at our AdChoice program. The effect of an opt-out will be to stop personalised advertising, but it will still allow the collection of information for certain purposes such as usage, research, analytics and internal online services operation purposes. In addition to that, we do not allow third parties to track or collect your personal information on our sites for their own advertising purposes without your explicit consent.
When you sign in to your account on our Services, we may give you the option to stay signed in to your account for a certain period of time. If you are using a public or shared computer, we encourage you not to choose to stay signed in. to participants of the Auction Hut VeRO Program globally under confidentiality agreement, as we in our sole discretion deem necessary or appropriate in connection with an investigation of fraud, intellectual property infringement, piracy or other unlawful activity. In such events, we will disclose a seller’s name, street address, city, state, postcode, country, phone number, email address and company name to the participants of the Auction Hut VeRO Program
to credit agencies or bureaus as authorised by applicable national laws (e.g. information on late or missed payments or other defaults on your account that may be reflected in your credit report or file)

Other Auction Hut users as authorised by you or your use of our Services
When transacting with another user, the other user may request and we may provide him/her with information about you necessary to complete the transaction, such as your name, user ID, email address, contact details, postage and billing address or other information from you needed to promote the reliability and security of the transaction. If a transaction is held, fails or is later invalidated, we may also provide the other user with details of the unsuccessful transaction. The other user receiving your information is not allowed to use this information for purposes unrelated to the transaction, such as to contact you for marketing purposes, unless you have expressly consented to it. Contacting users with unwanted or threatening messages is a violation of our User Agreement.
Data disclosure to PayPal Inc.
We may disclose your personal information to PayPal Inc. and its for the following purposes:
to prevent, detect, mitigate and investigate potentially illegal acts, fraud and/or security breaches, and to assess and manage risk, including to alert you if fraudulent activities have been detected on your Auction Hut or PayPal accounts
to provide customer services, including to help service your account or resolve disputes (e.g. billing or transactional disputes)
to facilitate the processing of payment cards when you pay within our Services with a payment card and we use PayPal as a payment processor

Change of Ownership
If we were to merge with or be acquired by another company, we may share information with them in accordance with our global privacy standards. When you share your personal information on our sites or applications – what happens?
Other users have access to the information you share on Auction Hut. For example, other users can see your bids, purchases, items for sale, your collections, the sellers and collections you follow, Storefronts, Feedback, ratings and associated comments. Other users can also see any information you chose to share in your profile or your collections.
Your user ID is displayed throughout Auction Hut and is available to the public. It is connected to all of your Auction Hut activity. Notices sent to other users about suspicious activity and notice violations on our sites refer to user IDs and specific items. So if you associate your name with your user ID, the people to whom you have revealed your name will be able to personally identify your Auction Hut activities.
To help protect your privacy, we allow only limited access to other users’ contact, postage and financial information as necessary to facilitate your transactions and collect payments. However, when users are involved in a transaction, they have access to each other’s name, user ID, email address and other contact and postage information.
How you should use the information you receive on Auction Hut
When you are in a transaction with another user, we enable you to obtain or we may provide you with the personal information of the other user (such as his/her name, user ID, email address, contact details, postage and billing address) to complete the transaction. We encourage you to inform the other user about your privacy practices and respect his/her privacy. In all cases, you must give the other user a chance to remove himself/herself from your database and give him/her a chance to review what information you have collected about them.
You may use the personal information that you have access to only for Auction Hut transaction-related purposes, or for other services offered through Auction Hut (such as escrow, postage, fraud complaints and member-to-member communications), and for purposes expressly consented by the user to whom the information relates. Using personal information of other users that you have access to for any other purpose constitutes a violation of our User Agreement.
Unwanted or threatening email
We do not tolerate abuse of our Services. You do not have permission to add other users to your mailing list (email or postal), call or send him/her text messages for commercial purposes, even if this user purchased something from you, unless the user has given his/her explicit consent. Sending unwanted or threatening email and text messages is against our User Agreement.
Third party privacy practices
This Privacy Notice addresses only the use and disclosure of personal information we collect from you. If you disclose your information to others, or if you are directed to a third party website, their privacy notices and practices will apply. We cannot guarantee the privacy or security of your information once you provide it to a third party and we encourage you to evaluate the privacy and security policies of your trading partner before entering into a transaction and choosing to share your information. This is true even where the third parties to whom you disclose personal information are bidders, buyers or sellers on our sites.
